I'm in a Kickstarter deal that is beginning to smell like a Skully. I went into it open-eyed though and if it falls through then it will just be a learning experience.

Its a telemetry-tracker called BRAIN for motorcycles and cars - its run by a bunch of guys out of Italy and its falling behind schedule. I signed up in December '15 with an expected delivery date of May '16. In May they announced a delay to September, and so it begins....

It was & still is - I would have loved and used the helmet but now I just wish I had the money back!

I managed to make some $ - foolishly decided to spend the last of it spoiling myself with this purchase. Instead it was taken - I bought this from their website and was by no means expecting it to be a risky investment - it was advertised as buying a product. Feel scammed.

With Kickstarter though, if funding is reached, and product isn't developed, you get your money back. Right?

Maybe not. If the people who fronted money, even though they were promised the product in the end, were considered investors, I would say no, as that is an accepted risk of investing in anything. I'm sure they have plenty of lawyers out there finding ways to deny refunds.

I'm sure there's verbiage on page 127 of some form I clicked "yes" to that absolves Kickstarter any liability for non-delivery of a product or something that doesn't meet the promoted capability. For how much I put in (can't remember for sure but think it was about $200) I wouldn't get my panties in a bunch over it or dream of talking to a lawyer.

If I had kicked in $1500 for a Skully, that might be a different matter entirely. I'm sure that the CEO that has recently been excused did pretty well financially for the last couple of years at the expense of early depositors so that would piss me off completely.

It's been my understanding with Kickstarter, that it's whole schtick, is that it's not an investment, and the funding is only withdrawn if goals are met. Kickstarter is the safety net essentially. I could be wrong, or there could be a catch somewhere, but that's the whole point of Kickstarter as far as I know.

Kickstarter only guarantees all sucker cards are charged when enough have pledged.

Backers are not investors and Kickstarter doesnt allow projects to offer equity of any return of any sort. Backers can only be offered "rewards" (sometimes but not always a copy of a product). Kickstarter does not guarantee the rewards will be delivered and has no enforcement mechanisms other than barring future projects on their site -- it's all reputation based.

I'm prepared for the worst if the BRAIN deal falls through. To be honest I put the money in so long ago that I've pretty much mentally written it off anyways. If it comes through it will be like an unexpected birthday present
